Supreme Court Decision and Trending Divorce Photoshoot

Two trends were noted this May 1st, 2023- both were about Divorce.

One was the Supreme Court ruling.

The other was a viral divorce photoshoot posted by an empowered artist.

On 1st May 2023, the Supreme Court (SC) ruled that it can grant divorce under Article 142 of the Constitution and has the discretionary powers to dissolve a matrimonial alliance that has broken down irretrievably. As per the Five-Judge Supreme Court Bench of Justices SK Kaul, Sanjiv Khanna, AS Oka, Vikram Nath and JK Maheshwari:

Grant of divorce (in case of irretrievable breakdown of marriage is not a matter of right, but a discretion to be exercised (by the SC) with great care & caution, keeping in mind several factors ensuring ‘complete justice’ is done to both parties.

SC must be fully satisfied that the marriage has completely failed… that the matrimonial alliance has become totally unworkable, emotionally dead and beyond salvation.

Though the Hindu Marriage Act gives a mandatory cooling-off period of six months in case of divorce through mutual consent, SC has the power to waive off the waiting period subject to conditions.

In cultures across the globe, marriage is a sacred insitution.

Divorce is not encouraged.

Last month, when Lauren Brooke celebrated her divorce by setting her wedding dress ablaze and stomping on photos and sharing those photos, there were sharp reactions.

Divorce is not taken very well across the world, especially in India.

The recent example is the feedback for artist Shalini's divorce photoshoot images.

Though there have been trolls, there has also been support and wishes for the courageous women.
